We disclaim all warranties including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that our services will be uninterrupted, error-free, or free from harmful components.

Limitation of Liability

To the maximum extent permitted by law, Willowmist shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from or related to your use of our services, even if we have been advised of the possibility of such damages. In no event shall our total liability exceed the amount you paid to us in the twelve months preceding the claim.

Consequential Damages

We shall not be liable for any consequential damages including, but not limited to, business interruption, loss of revenue, loss of opportunity, damage to reputation, or loss of data. This limitation applies regardless of the theory of liability, whether in contract, tort, negligence, or otherwise.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of nature, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

If informal resolution is unsuccessful, disputes shall be resolved through the courts of Budapest, Hungary. Each party shall bear its own costs and expenses.

If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from these terms, and the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced with a valid provision that most closely matches the intent of the original.

These Terms and Conditions, together with our Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and Willowmist concerning your use of our services. They supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written.
